What is the legal position?

What is the legal position regarding video/pictures posted on youtube if any of the people in them do not wish their image to be shown.

I just received a phone call from a former collegue - we couldn't talk as I was driving - but I suspect it will be a request to remove her picture from the video I posted.

Am I going to have to blur out everyone in that video apart from me?

It will kinda ruin it.

I think you should ask YouTube about that. My guess is that if pressure was put on them they'd remove the video in question.

Technically you have to get permission of anyone whose picture you’ll show on a public place — at least in British law. I don’t know how that applies to the web, and I certainly can’t square that with papparazzi snapping shots of celebrities against their will.

I'm pretty certain that if they have asked you to remove it, you have to.

I dont think it's legal to display images on the net without someone's consent. Don't quote me on that though.

I have a feeling I'm going to have to take the vid down - edit it - then put it back up.

Is there a way of doing that without having the url change - Pat Condel has put it on his page and that would screw it up.

You don't need permission is what I've been told, and I tried to prevent someone using pics. The mad thing is that the person who took the pic is the one that decides and can charge the person in the pic if they want to use it for themselves.

I have never uploaded a movie to YouTube, Hassan, but I'm pretty sure replacing a video whilst keeping the URL is not possible, because the new, edited content might not reflect the achieved ratings and statistics of the old video anymore. So it's probably a restriction in favour of keeping the data correct.

I'd suggest to write a short message to Pat explaining the issue. I'm sure he will add the edited video again to his favourites.
