Blasphemy Case of  Junaid Hafeez.,  and Murder  of his defense Lawyer Rashid Rehman

Rashid Rehman Khan was the coordinator of An official at the independent Human Rights Commission of Pakistan  HRCP  He was a committed rights activist and lawyer and had been associated with HRCP for over twenty years. The news clips says

    Quote
...It must be recalled that on 10 April, through a statement, the Commission had brought it to the attention of the authorities that Rashid was being openly threatened by prosecution lawyers in the Multan District Prison where he was representing a blasphemy accused. The hearing was being held in the prison due to security concerns. The judge, it was reported, did not take any notice of threats issued to Rashid in his presence. Three persons had addressed defence lawyer Rashid Rehman in the judge’s presence and said: ‘You will not come to court next time because you will not exist any more.’

It is regrettable that no attention was paid to HRCP’s or Rashid’s concerns and nothing was done to apprehend the three persons who had threatened Rashid

But Rehman, who was also a rights activist and coordinator of the HRCP, decided to defend Hafeez. During the first hearing in March this year, which took place inside a prison for security reasons, Rehman received threats allegedly from the complainant's lawyers

HRCP  lawyer Rashid Rehman  was defending  Junaid Hafeez who was accused by his students and colleagues Blaspheming against Prophet Muhammad ., Mr. PBUH.

Junaid Hafeez, was  visiting lecturer in English, Bahauddin Zakaria University (BZU), Multan, He studied American Theater and Literature at Jackson State University in the United States, graduating in 2010.   This is what one of the FOOL Aisha Javed writes on that case apparently she was friend of Junaid Hafeez,
    Quote
“O Lord save me from knowledge which leads to destruction.”

How was the paper? I asked him.
Hmm… was good. He replied through text.
And how was the day? I texted again.
The day was ok. Today our seniors were very excited. He said.
    Why? I questioned.
Because Junaid is coming to our university.
    Junaid? I sent.

He was a senior student and was very intelligent. He got a scholarship last semester and went to America to work in an American theatre. Now he’s back in Pakistan. Ashraf, he is so very intelligent and now he will take classes of the final semester with us. Usman answered.
Oh good. It will be helpful for Abdullah as he feels so lonely. (He was from Turkey).
Usman is my close friend and was doing the 4-year BS in English.

We shared news, incidents etc. with each other daily and thus I was introduced to Junaid.
After a week I went to visit Usman in the English Department.“Look, there is Junaid,” Usman gestured towards him. I was surprised to see him. He was totally different from the image I had in my mind. A very simple and modest person, dressed in a simple shalwar kameez and with bowed eyes.

Usman was telling me that Junaid used to stay in the hostel of King Edward Medical College Lahore when he started reading English novels. He left medical and took admission in BS English. He was a throughout topper and had been living in America for the last six months on a scholarship.

A strange thing he also told me about him was that he used to argue about Allah سبحانہ وتعالی with his class fellows and that he didn’t believe in Allah. That was shocking for me because he was a good Muslim before going to America.

And the time flew away. Usman completed his degree and left the university. I came to know that the university had appointed Junaid as a lecturer while he was doing his M. Phil. One day my friends and I were in front of the new English Departmentwhen we saw scores of boys and girls from the Undergraduate Study Centre (UGS) Department enter the English Department.

They were protesting against someone and were shouting slogans:

    “Ghulam hain Ghulam hain
    Rasool kay Ghulam hain
Ghulami-e-Mustafa mein mout bhi qabool hae.”

    Quote
The next day I came to know about the protest from the newspaper. The students were protesting against Junaid Hafeez who had posted blasphemous blogs on Facebook against Rasoolullah صلی اللہ علیہ وسلم. The D.C.O Multan had arrived but Junaid had run away. He had been fired from his job and an F.I.R had been registered against him. Now he had been caught from Lahore and his case was pending in the court.

    Quote
    Press note about him ran:

MULTAN, March 14th: A visiting teacher, Junaid Hafeez of the English Department of the Bahauddin Zakariyyah University, Multan, was sent to prison on judicial remand by a local Magistrate Kashif Rasheed, Court officials said. Regional Police Officer Aamer Zulfikar said, “We arrested the teacher from Lahore and took him back to Multan and we have registered a case against him under section 295- B and 295-C PPC. A four-member committee headed by SP (City) Naeem-ul-Hasan Babur is investigating the case.  The accused is said to be guilty of blasphemy and denying the presence of Almighty Allah. Junaid Hafeez made off on Wednesday when enraged students staged a demonstration against him and shouted slogans. A heavy police contingent was deployed in the University which controlled the situation. Vice Chancellor Syed Alqama said, “We have terminated his contract as a visiting teacher and got vacated the room in the hostel.” Regional Police Officer Aamer Zulfikar said, “We have recorded the statements of the students of the English Department and they have also produced documentary proof against him. The students of the English Department told newsmen that Junaid Hafeez used derogatory remarks about Prophet Muhammad صلی اللہ علیہ وسلم and Almighty Allah in his lectures. They had lodged a number of complaints to the University administration but no action was taken. Consequently they had staged a demonstration in the campus to protest against the blasphemy.

This incident rattled me. Being brainy is a great blessing of Allah but brains must be used in the righteous way. Getting knowledge is good but you must avoid the literature of non-Muslims. And we should always pray to Allah سبحانہ وتعالی to save us from the wrong use of our intelligence.

what bothers me is why intelligent people like Aisha writes

" Being brainy is a great blessing of Allah but brains must be used in the righteous way. Getting knowledge is good but you must avoid the literature of non-Muslims. And we should always pray to Allah سبحانہ وتعالی to save us from the wrong use of our intelligence"

well I say being brainy is CURSE IN ISLAM... you got to be BRAINLESS CREATURE to be Muslim like Aisha Javed ., let me see whether I could send her e-mail with a link to this folder.

Well RIP  Rashid Rehman., And I am not sure about the fate of Junaid Hafeez, ., He could have stayed in America. instead of that he went for teaching in great  LAND OF PURE  and landed in jail with  wearing a  "KILL ME  FOR BLASPHEMY "  t-shirt..

Do not let silence become your legacy.. Question everything
I renounced my faith to become a kafir,

    Brave men. ..............

indeed there are,  there were brave men and women in Pakistan before it became Pakistan and after the birth of Pakistan.   ,Asma Jahangir is one of them,  still alive.,  in the tube below she speaks about Rashid Rehman
    http://www.youtube.com/watch?v=Ec-2YU4xjeo
Well it is life one day it has to go...... but it is important to live the life to make it better for others .. And Rashid Rehman was one of them...

Anyways another brave Soul Sana   Saleem   from Pakistan writes about this murder  in dawn Let's wait for the next Rashid Rehman to be murdered  Let me add a bit from her
    Quote
It is beyond tragic that the men that shot human rights advocate Rashid Rehman five times, had to pretend to be clients in order to kill him. After all, why should pious men undertaking God’s work ever have to come in disguise like cold blooded cowards?

They should have learnt a thing or two from their comrade, Advocate Zulfiqar Sindhu, who being the self-appointed messiah that he is, blatantly pronounced a death sentence for Rehman in an open court.

    What a remarkably honest man...

Here Sana speaks about Pakistan Cracks Down on Internet Activism

Junaid Hafeez_  A Classic  Case Pakistan’s Tyranny of Blasphemy

    Quote
LAHORE, Pakistan — “I used to feel my life was too straight, too linear.”

The speaker was Junaid Hafeez, a young poet and Fulbright scholar from the south of Pakistan, telling a radio show host in 2011 why he had given up studying medicine for a life in literature. Today, he is in jail on a blasphemy charge that carries the death penalty, and is mourning the lawyer who was murdered earlier this month for defending him.

Before his arrest, Hafeez was teaching in the English Department at Bahauddin Zakariya University in Multan, a city in Punjab Province close to where he grew up. His personal charisma and liberal views had won him a following among students, as well as the envious attention of faculty members.

One day in 2013, a student affiliated with Islami Jamiat Talaba, a wing of the hard-line Jamaat-i-Islami party, accused Hafeez of insulting the Prophet Muhammad on Facebook. The student had no evidence, but no evidence was needed.

Hard-line students soon held a protest crying out for Hafeez’s execution. University administrators backed away. The police registered a case for blasphemy against Hafeez. They did not ask cybercrime specialists to investigate the accusation, relying instead on a fatwa issued by a seminary.
    Quote
For months Hafeez’s father tried to find a lawyer. Finally he petitioned Rashid Rehman, the 53-year-old special coordinator for the Human Rights Commission of Pakistan in Multan. A legal expert with 20 years of activism, Rehman was known as a go-to lawyer for hopeless causes. Despite the danger, he agreed to take Hafeez’s case. Defending a man accused of blasphemy, Rehman told a reporter in April, was like “walking into the jaws of death.”

Those jaws have been open wide since the 1980s, when the military dictator Gen. Muhammad Zia ul-Haq updated a set of colonial laws that criminalized “insulting the religion of any class of persons.” The original laws were devised in the late 19th century by a paternalistic British government trying to keep its multifaith subjects from fighting one another. Those laws were worded generally, and prescribed fines and, at most, two-year prison terms.

General Zia’s amendments particularized the insults and tailored the provisions to favor a stringent Sunni strain of Islam. They criminalized the desecration of the Quran, any defiling of the name of the Prophet Muhammad, and disrespectful remarks about his companions  The blasphemy laws are part of this package. For decades they had been rarely used, with only a handful of cases before the mid-1980s.

But General Zia’s amendments opened the floodgates: More than a thousand cases have been reported since then, according to the Human Rights Commission of Pakistan. Just last week the Punjabi police, prompted by a Sunni extremist, brought blasphemy charges against 68 lawyers.

The blasphemy laws can serve just about anyone with a dark design — an angry relative, an envious colleague, a neighbor with his eye on your property. But the greatest beneficiary has been the professional Islamists, who specialize in their application to encroach on both state and society.

    Quote
I got a sense of this in August 2009 when I visited the torched Christian neighborhood of Gojra, a small city in the heart of Pakistan. A Muslim peasant had spread a rumor that Christian neighbors had desecrated a Quran, and it degenerated into a riot after clerics riled up Muslims with hysterical broadcasts from the loudspeakers of mosques. When the police tried to stop the mullahs, they quoted the blasphemy laws and threatened to turn the mob against the authorities for “protecting the blasphemers.” Some 60 Christian houses were set on fire and eight Christians killed.

The Islamists would have us think that all believers are susceptible to spontaneous eruptions of violence when their religion is offended. But the reality, as documented by a government report on the Gojra incident, is more treacherous and tragic. A blasphemy charge, once taken up by a religious activist, can legitimate myriad other interests, from petty personal needs to large political plans, and create an exhilarating free-for-all atmosphere. The Gojra rioters included the constituents of the local opposition politician, peasants and day-laborers from neighboring areas who joined in the looting and armed members of the now-banned Sunni militant group Lashkar-e-Jhangvi.

Pakistan’s Islamist groups have little incentive to reform the blasphemy laws. They have even expanded the understanding of blasphemy so that it now includes any criticism of the laws themselves. This has been achieved by targeting high-profile dissenters, like Salmaan Taseer, a governor of Punjab province, and Shahbaz Bhatti, a federal minister for minorities, who were both assassinated in 2011.  And then, just two weeks ago, there was the murder of Rashid Rehman.

They closed in on him as mafias do, from all sides. First there were encoded warnings in Urdu newspapers, describing a lawyer who was out to “hurt himself.” Then there was a press conference in Multan at which a group of stern-faced clerics accused Rehman of trying to make an international issue of the Hafeez case. In April, during Hafeez’s trial, three lawyers for the prosecution told Rehman in front of the judge that by the next hearing he “would not exist.”

Rehman’s colleagues at the human rights commission urged the government to provide him with security. They got no help. The ruling Pakistan Muslim League-Nawaz party has a history of placating extremist groups, like the Pakistani Taliban, to gain political mileage.

On the night of May 7, two young men walked into Rehman’s office near the district courts in Multan, shot him dead in front of his colleagues, and fled into the night. The next morning, almost every newspaper in Pakistan described them as “unidentified individuals.” But what killed Rehman can be identified: It was violent zealotry, aided and abetted by the state.

all that is written by Ali Sethi is the author of “The Wish Maker,” ...

now there is no one who can defend Junaid Hafeez., If he walks out of the Jail his fate is sealed ., Inside the jail he has to be isolated from other inmates other wise, a blasphemer in Pakistani jail is as good as dead..

Well this case is very similar to that of Dr Ifthikhar Ahmed Sheikh

That is 68 year old  Dr. Ifthikhar Ahmed Sheikh  and this is his  bio data
    Quote
Dr. Shaikh Iftikhar Ahmad’s nephew, Shaikh Usman Rashid, son of Abdur Rashid, resident of Jamia Masjid Road, Rawalpindi, lodged a complaint against him for writing the blasphemous book. The police referred the complaint to the Legal Branch for legal opinion, but people belonging to a religious sect surrounded the Industrial Area Police Station and demanded an FIR against the accused under the blasphemy law.

The protesters, on Sunday, blocked the IJ Principal Road to register their anger against the police. The police, finally, registered FIR (No. 466) under Section 295/C after receiving legal opinion from the Legal Branch and arrested the accused.
    Quote
Police said that the accused, Professor Dr. Shaikh Iftikhar Ahmad, completed his PhD from the United States and opted the profession of teaching and worked at different universities in the US. He later became president of American Research Association. He returned back to Pakistan five years ago, but couldn’t go back to America due to serious illness.

The police have shifted Professor Dr. Iftikhar to unknown place for investigation and appointed SP (Industrial Area Zone) as the inquiry officer, adding that the accused would be produced before the court of law today.

and that is the life of blasphemy accused in Land of pure

Dr. Iftikhar Ahmed Sheikh Blasphemy  case Back in the news From LAND OF PURE...
    Quote
Family disowns former blasphemy accused but not his wealth   writes MALIK ASAD   in Dawn

ISLAMABAD: The family of a wealthy old man, accused and later acquitted of blasphemy charges, has approached a civil court of Rawalpindi, seeking ownership of Rs127 million worth of saving and income certificates.

Seventy-year-old Dr Iftikhar Ahmed Sheikh was booked for blasphemy in December 2012 after a complaint was lodged against him by his nephew Usman Rashid Sheikh, at the Industrial Area Police Station. Dr Sheikh was accused of authoring books in 2001 with alleged blasphemous content.

Before his nephew lodged the complaint, Dr Sheikh had reportedly served a Rs5 billion notice to his nephew in a civil matter. Additional district and sessions judge Rafaqat Awan acquitted Dr Sheikh on February 2, 2013 from the blasphemy charges.

Following the acquittal, Dr Sheikh along with his family members sought asylum in the United States citing threat to his life as the reason, but his asylum case was not finalised as his children refused to go with him.
    Quote
His wife, two daughters and son have now petitioned before the civil court in Rawalpindi, seeking ownership of saving and income certificates worth Rs127 million. According to the petition, Dr Sheikh is a millionaire with “different properties, cash deposits in foreign banks in US and UAE, and he owns regular income certificates and special saving certificates under his name”.

The petition claimed that since his children and wife do not agree with Dr Sheikh’s opinions, they refused to seek asylum with him anywhere as this would be akin to supporting his past blasphemous views.  According to the petition, their father “out of love and affection for the plaintiffs” (the family) had gifted Rs127 million worth of saving and income certificates to his family before leaving for the United States in July 2013.
    Quote
But the petition alleged that in 2015, Dr Sheikh “attempted to compel the plaintiffs to follow his misconceived, blasphemous and apostate ideology. The plaintiffs reminded him of the repentance and remorse which he had after the registration of a blasphemy case against him but he had made it clear to the plaintiffs that it was only temporary as his life and liberty were under threat. Otherwise, his books and his ideology is the same and his misguiding, blasphemous, apostate and anti-Islamic books are once again ready for publication in foreign countries”.

The petitioners alleged that their father had planned to transfer the income and saving certificates to the family members but did not do so “as punishment for not following his apostate religious views”.

Dr Sheikh had filed a suit in the civil court of Rawalpindi on June 19, 2015, against one of his daughters, stating that she is not the real owner of the certificates. He petitioned before the court that the documents of ownership shown by his family members are forged and he never gave the certificates as a gift.

The petition requested the court to pass a decree in favour of the family members and to restrain Dr Sheikh from transferring the said certificates to a third party.

    Quote
When Dawn contacted the counsel for the plaintiffs in the recent case Advocate Saeed Khurshid Ahmed, he said that his children and wife have a right to the man’s property. And since the certificates had been presented as a gift from Dr Sheikh, he could no longer claim ownership of the certificates. He said the family dissociated from Dr Sheikh’s anti-Islamic ideology and refused to settle with him abroad.

On the other hand, a human rights activist Zuhra Yousaf said a majority of blasphemy cases are motivated by personal grudges.

She said often blasphemy sections of the law are invoked to settle personal scores. “The life of the accused is endangered when such an allegation is made,” she said. Ms Yousaf added that the district administration is required to provide security to Dr. Sheikh as his life is at risk.

Prosecution seeks forensic audit of laptop of blasphemy accused Junaid Hafeez    says news

    Quote
LAHORE: The Prosecution on Wednesday filed three different applications in a blasphemy case against a lecturer and requested the trial court to summon Punjab Forensic Science Agency (PFSA) expert and sought permission to get forensic examination of a laptop and a cell phone belonging to the accused.

A Bahauddin Zakariya University visiting lecturer, Junaid Hafeez, was booked on blasphemy charges and was arrested by police on March 13, 2013. The trial of the case started in 2014.

The defence counsel had already completed the cross examination of the witnesses presented by the prosecution. On Wednesday, the court was supposed to record statement of the accused under section 342 of the Criminal Procedure Code (CrPC).

However, the prosecution filed three new applications, including the one for sending laptop and mobile phone recovered from the accused at the time of his arrest in 2013, another for de-exhibition of some documents and the application filed under section 540 of the CrPC, along with section 94 of the CrPC, for summoning an expert working for the PFSA who prepared a report on the evidence gathered by police.

The defence counsel also submitted an application requesting the court to hold the trial proceedings on a daily basis. The court sought arguments both from prosecution and defence sides on Sept 25 and adjourned the hearing.

The protests began on Saturday after a first information report of (FIR) was filed against a principal — who is from the Hindu community — of Sindh Public School on the complaint of Abdul Aziz Rajput, a student's father who claimed that the former had committed blasphemy. The FIR was lodged under Article 295(c) — that pertains to "derogatory remarks in respect of the Holy Prophet (PBUH)" — of the Pakistan Penal Code.

Residents of the area demanded the police to arrest the principal, and issued a call for a shutterdown strike and took to the streets in protest. Videos of stick-wielding protesters were shared on social media on Sunday, in which they were seen vandalising a Hindu temple and damaging the school where the alleged incident took place.

Ghotki Senior Superintendent of Police Farrukh Lanjar, while talking to local reporters, said that police were controlling the law and order situation in the area.

Advocate Veerji Kolhi, special assistant to Chief Minister Sindh on Human Rights, told Dawn: "The situation is being handled properly to avoid further damage or riots."

The Human Rights Commission of Pakistan also shared a video of protesters breaking infrastructure of the school and expressed concern over the situation.

"Alarming reports of accusations of blasphemy in Ghotki and the outbreak of mob violence," the rights organisation said in a tweet.

I don't expect any statement by pti to defend religious minorities. In all likelihood, the mob and noose will come for imran at some point in the future.

I fully agree with that.. that is what the past governments in Pakistan did .. KEEP QUITE ON THESE BLASPHEMY LAWS..... after  allah took away that horrible creature ..

Imran Khan  is crowd appeaser  but when it comes to policy.. he has serious  problem in understanding the problem .,

Anyways., it is one year in to politics ., he could not amend those stupid blaspheme laws of Pakistan  for which his party has full support even from opposition members to modify that law in Land of pure .. But he too is  playing politics with it...  And individual like dr. Junaid Hafeez  or that hindu teacher  and their families will suffer ...

Teacher’s blasphemy trial enters final stages   says Dawn news  with this picture

    Quote
ISLAMABAD: A court will hear final arguments on Thursday in the blasphemy trial of a former university lecturer a week after a US religious freedom commission placed his name on its list of global victims, his lawyer said.

Junaid Hafeez has been in solitary confinement for fear of being attacked by fellow inmates in jail since his arrest in 2013 on blasphemy charges linked to online posts.

In 2013, students at a Multan university where Hafeez taught English literature accused him of blasphemous Facebook posts.

His lawyers say he was framed by students from an extremist party for his liberal and secular views.

“It is a kind of a recognition that people are being persecuted in Pakistan for their belief and freedom of expression,” his lawyer, Asad Jamal, told Reuters.

Airing noncomformist views in public isn't without consequences in any society. There are three options: keep quiet, stay anonymous or change country.

When the consequences are severe then you must remember that inferred speech (rather than your actual words) will be used against you.

I would question that   dear crumble... we must realize the basic differences between Christianity and Islam ., Islam follower/Muhammad(PBUH) followers inherently more violent  on a given issue specially w.r.t Blasphemy of their respective faiths than Christianity/Christ followers

and you can see that right from the get go even before medieval times.

Academic Junaid Hafeez sentenced to death on blasphemy charges by Multan court  says News ]

    Quote
A district and sessions court on Saturday sentenced Junaid Hafeez, a former university lecturer in Multan, to death on blasphemy charges.

Formerly a visiting lecturer at the Department of English Literature of the Bahauddin Zakariya University (BZU), Multan, Hafeez was booked on blasphemy charges and was arrested by police on March 13, 2013. The trial of the case started in 2014.

According to Amnesty International, Hafeez, who was also in the process of getting a graduate degree in English Literature, was charged with blasphemy over Facebook uploads.

    Quote
Additional Sessions Judge Kashif Qayyum sentenced Hafeez to death and a fine of Rs0.5 million under Section 295-C of the Pakistan Penal Code (PPC); in case of default he will undergo further imprisonment of six months.

He was also sentenced to life imprisonment under Section 295-B, and 10 years' rigorous imprisonment and a fine of Rs100,000 under Section 295-A of the PPC

According to the court's short judgement, "All the sentences shall run consecutively and the accused would not be entitled to the benefit of Section 382-B CrPC because in case of blasphemer, this court has got no circumstance for taking [a] lenient view and it is also not permitted in Islam.".

Hafeez has been lodged in the high-security ward number 2 of New Central Jail Multan.

His previous lawyer, Rashid Rehman, was shot dead in May 2014 in his office. At least nine judges were transferred through the course of Hafeez's case.  Prosecutor Athar Bukhari said Hafeez had spent three years in the United States under a special programme for Pakistani educators.

The prosecutor said investigators retrieved anti-religions material from Hafeez's laptop after his arrest.....................

    Quote from:
The Islamabad High Court (IHC) on Friday rejected a petition against Prime Minister Imran Khan that had accused him of committing blasphemy

“A person’s faith or belief is not open to be questioned by any other person. Moreover, a mistake or error committed by a person while addressing a public gathering cannot be treated as blasphemous when the facts and circumstances clearly establish that he or she could not have intended to commit such an offense,” ruled the court.

“Faith or religious belief is a personal matter and should not be questioned by others. Likewise, extreme caution has to be exercised in making allegations relating to blasphemy,” the verdict noted.
